Personal Injury

If you are involved in an automobile accident or collision, you may be entitled to recovery of damages by a negligent party’s insurance company and/or by your own insurance company. It is important to act quickly after being involved in an accident, as your actions can impact your potential damages, and an experienced attorney will ensure that you do not compromise yourself.

Although Automobile drivers are vulnerable to negligence on the road, motorcyclists are especially vulnerable. Motorcycle accident claims often give rise to substantial claims for damages due to the fact that bike riders are one of the most vulnerable classes of road user, and the number killed or seriously injured continues to rise year by year.

The prime cause of motorcycle accidents relates to the negligent actions of other road users particularly car drivers who tend to be inattentive towards motorcyclists and fail to anticipate their presence or actions

Both Automobile and Motorcycle accidents generally lead to a wave of insurance forms, accident reports, medical bills, and other red tape. Immediately following an accident, it is important to gather as much information as possible, such as names, addresses, drivers license numbers, and insurance companies, from others involved in the accident as well as witnesses. Alex Dehghani is familiar with the legal system and the way insurance companies work and can help to navigate this process.

Wrongful Death

Wrongful death occurs when someone's death is caused by the negligence of another person, company, or other entity. Wrongful deaths can involve automobile accidents, medical malpractice, misuse of prescription drugs, or numerous other situations.

The purpose of wrongful death laws is to compensate the survivors of a victim of wrongful death. Potential damages awarded and those that are considered to be "survivors" vary from state to state, but generally, survivors include immediate family members of the victim. Those who bring a valid wrongful death claim can be compensated for many forms of loss, including:

  • Medical and funeral expenses of the victim
  • Loss of the victim's anticipated lifetime earnings
  • The survivors' emotional pain and suffering
  • The survivors' loss of companionship
  • Punitive damages (in some states)

Despite the difficulty of losing a loved one, it is important to contact the Dehghani Law, P.A. immediately if you believe that you have a valid wrongful death claim. We can assist in making numerous time-sensitive decisions that could affect your case.

Product Liability

Manufacturers can be held liable for injuries that are caused as a result of a defective product. Injuries from defective products can occur at home or in the workplace. Consumers have rights that protect them from defective products, and manufacturers have a legal obligation to provide consumers with safe products Product's are considered defective if they contain a manufacturing flaw, a design defect, or an inadequate warning.

If you are injured by a defective product, save the product for inspection and contact Alex Dehghani at Dehghani Law, P.A. immediately.

Dog Bites

A dog owner has an obligation to restrain his or her animal for public safety. As long as you are on private property legally (or you are on public property) the dog owner may be held responsible.

Dog bites should be reported as soon as medical attention is supplied. Report this to your local animal control and/or the police department. Keep a note of the date of the report and the name of the person that you spoke with.

If attacked by a dog:

  • Seek medical attention.
  • Report the dog bite or attack to the proper authorities.
  • Photograph the wounded area.
  • Write down names and contact info for any witnesses
  • Contact Attorney Alex Dehghani immediately.

Pharmaceutical Liability

Manufacturers of drugs, medications, and medical devices have a duty to consumers to provide products that are reasonably safe when used as intended. A product's approval by the FDA alone does not allow a manufacturer to avoid liability.

Companies are obligated to inform the public of a product's risks, and the required methods of informing the public vary by the type of product. With non-prescription drugs, proper labeling and enclosures are generally sufficient. However, prescription drugs are used under the supervision of a physician, and as a result, the manufacturing company only has a duty to inform the physician.

If you have any questions about a product, contact Attorney Alex Dehghani immediately.

Nursing Home Neglect

More than 30 percent of the country's nursing homes have been cited for violations that put residents in harm's way. Negligence and abuse in nursing and residential care facilities in Florida has unfortunately become common. Nursing homes in Stuart, Port St. Lucie, Palm Beach, Vero Beach and Okeechobee and throughout Florida are cited with violations of state and federal law on a daily basis, and your loved ones may be the victims of this widespread neglect and abuse.

The most common types of neglect and abuse are malnutrition, dehydration, pressure sores, infections, falls, burns, and assaults. These injuries are often caused by understaffing and lack of supervision. If you have questions about the quality of care your loved one receives, please view Florida Statutes 400 along with Florida's Nursing Home Watch List for more detailed information.

Slip and Fall

The term "slip, trip, and fall" describes the type of injury that occurs on someone else's property, usually as a result of a defective surface, a slippery substance, or other dangerous conditions. These injuries most commonly occur at restaurants, supermarkets, and shopping malls. The fact that you become injured from a slip, trip, and/or fall does not necessarily mean that someone else is legally responsible for your injury. The owner or operator of a business has a legal duty to maintain the premises in a reasonably safe condition, or at least warn the public of a dangerous condition that they either caused, know about, or should know about.

If these tests are not met, and you injure yourself on their property as a result of their failure to meet these conditions, you may have a valid claim against the business owner or operator.

If you are injured in a slip and fall accident, please contact Attorney Alex Dehghani immediately.

Inadequate Security

Inadequate security cases generally involve a breach of security at a commercial establishment or at an apartment complex. Typically, the case would involve proof that the defendants knew, or should have known, that there was crime in the area, and that their security patrols, lighting, and security hardware, such as doors and windows, were not adequate, resulting in a breach of security on the property.

Contact Attorney Alex Dehghani today if you believe you have a case dealing with Inadequate Security.
